‘you’ and ‘your’ refer to you and any other party to your request for proposal listing.
www.mortgagesandloans.ie means any M&L website, and includes our associated services and the software and other material underlying and forming part of the M&L website or our services.
2.1 Mortgage And Loans Ireland (M&L) is an Internet Marketing company offering a free advertising service to borrowers and a paid advertising service to lenders/brokers. M&L does not take a commission on your advertised loan request nor do we act as a mortgage intermediary. M&L operate completely independent of lenders, brokers and other Financial Service providers. We are not the agent, partner or other representative of any lender, broker, intermediary or financial loan service provider. We have no authority to bind any lender or make any promise or statement on behalf of any lender/broker. Neither are we responsible for anything a lender/broker does or does not do.
2.2 We provide www.mortgagesandloans.ie for you to use on these terms of use, including in particular the disclaimers and limitations of liability in clause 6. Once you choose your preffered broker/lender you will deal directly them. M&L's role as an advertising agency ends at that point. We are not a party to any transaction or agreement you enter into with your chosen broker/lender.
3.1 To use www.mortgagesandloans.ie you must be an Irish resident aged 18 years or over or an EU company in each case seeking a Euro (€) residential home loan in Ireland.
3.2 All advertisments you publish (Requests For Proposal) must be in good faith, with a genuine interest in obtaining a loan.
3.3 All information you provide through www.mortgagesandloans.ie must be true, accurate, up to date and complete, and include all information reasonably required for a broker/lender to assess your request.
3.4 You decide which, if any, response you accept. We and registered brokers/lenders would expect you to proceed with an application process after you make your chisen selection
3.5 You must not show a www.mortgagesandloans.ie response to any broker/lender or ask any external third party to match or better any www.mortgagesandloans.ie generated response.
3.6 the www.mortgagesandloans.ie borrower advertising service is for use by genuine borrowers only and requests for proposal may not be made by brokers, financial advisers or other agents on behlaf or their clients. If you do use a broker, financial adviser or other agent to assist you in listing a request for proposal via www.mortgagesandloans.ie, you are solely responsible for any fee that broker/lender may charge you for those services and either M&L nor any lender has any liability to you or the broker, financial adviser or other agent in that regard.
3.7 You must keep your username and password strictly confidential. If for any reason you believe that your login details may have been compromised you must immediately change your password and let us know of the problem by emailing our help desk.
3.8 The use of www.mortgagesandloans.ie is a privilege not a right. We may in good faith, in our absolute discretion, at any time and without notice:
(a) suspend, extend, restart or cancel any request for proposal;
(b) remove any proposal (brokers/lenders’ can also remove proposals made in error within 1 hour or at any time where there has been a material change to borrower information);
(c) bar any person from using www.mortgagesandloans.ie, including, if we consider the person has breached these terms; or
(d) take any other action we consider desirable to protect the quality, security or integrity of www.mortgagesandloans.ie, and you agree that you will only use www.mortgagesandloans.ie as it is intended to be used.
We (and our licensors or suppliers, as applicable) own all copyright and other intellectual property rights in www.mortgagesandloans.ie. We reserve all our rights.
You may download, print and store any part of www.mortgagesandloans.ie for your personal non-commercial use. Otherwise, you may not in any form or by any means copy, reproduce, modify, create derivative works from, distribute, or publicly display anything from www.mortgagesandloans.ie without our (and any applicable third party’s) prior written consent.

6.1 Even though www.mortgagesandloans.ie may be reffered to as an auction website, we are not auctioneers (under the Auctioneers Act or otherwise).
6.2 If any part of these terms of use are held to be invalid, unenforceable or illegal for any reason, then that part shall be severed or amended to the minimum extent necessary for the balance of these terms of use to continue in full force and effect.
6.3 Your obligations under these terms of use are also for the benefit of any lender whose proposal you accept.
6.4 These terms of use contain everything we have agreed in relation to your use of www.mortgagesandloans.ie. You cannot rely on anything else said or done by us (or any of our representatives).
6.5 These Terms and the use of www.mortgagesandloans.ie is governed by the laws of the Republic of Ireland. You agree to the jurisdiction of the Republic of Ireland courts.
